1. Scope of application
These terms and conditions apply to every order placed via the Ferivan Modelbouw website. An order is considered to have been placed when the user, after identifying himself, clicks on the "confirm" button on the "Order confirmation" page. By placing an order, the user agrees to the General Terms and Conditions of Sale.

2. Parties
The natural person who enters his personal data on the website of Ferivan Modelbouw is hereinafter referred to as the "User". The User who places an order is further referred to as the "Customer". Ferivan Modelbouw, Vrijheid 34 C, 2320 Hoogstraten is further referred to as "Ferivan Modelbouw".

3. Jurisdiction
By placing an order, the Customer indicates that it can conclude a legally binding agreement. The order is a legally binding sales agreement between the Customer and Ferivan Modelbouw and is governed by Belgian law. Any dispute regarding the application, interpretation, resolution and/or termination of these agreements falls under the exclusive jurisdiction of the courts of the judicial district of Turnhout.

If you wish to delete your data, please send an email. Ferivan Modelbouw will respond to your request as soon as possible, but within four weeks.

6. Prices
The prices are stated in euros, including VAT and excluding shipping costs. The Belgian VAT rate of 21% applies. The prices quoted by Ferivan Modelbouw can be changed at any time. All prices are stated subject to typing errors.

7. Stock level
The stock level stated with each item is for informational purposes only. This has the theoretical representations of the availability of the products. Ferivan Modelbouw cannot be held liable for any errors with the stock of the ordered products.

8. Payment
Ferivan Modelbouw does not ship orders for which payment has not been made in full. The Customer will transfer the order amount within 2 weeks on the basis of the payment options offered by Ferivan Modelbouw. If Ferivan Modelbouw still has not received payment 2 weeks after placing the order, the order will be considered canceled by the Customer. Ferivan Modelbouw is then no longer bound to fulfill its obligations with regard to this order. If the Customer already failed to fulfill its obligation to transfer the order amount within 2 weeks in the past, Ferivan Modelbouw reserves the right to unilaterally cancel any order from the Customer without cancellation costs.

9. Delivery time
Due to low stock levels, an item may not be in stock when ordered. Ferivan Modelbouw will make every effort to deliver the ordered items as quickly as possible. The final delivery time also depends on the chosen transport company, which is responsible for delivery to the customer. All parcels are dispatched at the Customer's risk. Additional shipping insurance may be taken out but only covers the loss of a parcel.

10. Shipping
Ferivan Modelbouw sends insured packages with the Belgian Post. The shipping costs depend on the weight. The Customer confirms that the delivery address specified in the electronic order form on the website of Ferivan Modelbouw is correct. Ferivan Modelbouw is not responsible for an incorrect delivery if this was caused by the incorrect delivery address being specified by the Customer.

If the package could not be delivered to him due to absence, the Customer is obliged to collect the package at the collection point where the package is available. If the customer has NOT collected his package and the transport company has to return it, the costs of return will be deducted from the possible refund. If the customer fails to pick up his orders several times, Ferivan Modelbouw has te right to refuse future orders.

11. Return & Warranty
If the Customer finds upon receipt of his package that the package does not contain the products he ordered, he must report this to Ferivan Modelbouw by Mail/Letter/Fax.

If the products are damaged by the transport company, Ferivan Modelbouw will only intervene if this was an insured shipment. You must contact Ferivan Modelbouw within 2 working days of receipt and take a photo of the damaged delivery.

If the products are damaged and need to be repaired under warranty, the Customer must report this to Ferivan Modelbouw by Mail/Letter/Fax before returning them.

All shipping costs associated with a return shipment and any replacement shipment following the return shipment are always at the expense of the Customer.

When there is NO Warranty:

• In case of incorrect use of the goods
• Other warranty provisions (see warranty goods)

12. Right of withdrawal
The Customer has the right to inform Ferivan Modelbouw that he renounces the purchase, without payment of a fine and without giving any reason within 14 calendar days from the day following the delivery of the product or the conclusion of the service agreement.

The legal right to dissolve the purchase within 14 calendar days only applies to Customers whose purchase outside the company buildings. This regulation does not apply to buyers who act in the exercise of their profession or business.

Buyers who want to make use of this option can make their declaration of dissolution known in writing by letter, fax or e-mail within 7 working days after receipt of the product.

The product must be returned undamaged and in good condition in the original unopened packaging no later than 7 days after dissolution of the agreement. The purchase price will be refunded to the Customer by Ferivan Modelbouw within 30 days of the date on which the document by which the cancellation was invoked has reached the seller, if the conditions for the correct return have been met. During the cooling-off period you are entitled to check whether the delivered goods are in accordance with the offer. However, this does NOT include the right to use the products should you decide to return them. If the products are not returned by the Customer or are returned in a damaged or diminished condition, the Customer must compensate the resulting damage. The Customer can avoid the obligation to pay compensation by not using the product after delivery and, moreover, by taking all the necessary care to prevent damage or damage. Therefore, please also keep the packaging material in which the items were originally delivered. Articles that are returned during the cooling-off period must in any case always be packed in the original packaging, together with all accessories, such as cables, instructions for use and the like. The costs for returning are always borne by the Customer and can never be recovered from the sales.

The right of withdrawal expressly does not apply to:

• products that have been created in accordance with the Customer's specifications
• products that cannot be returned due to their nature
• products that can spoil or age quickly
• products from which the warranty seal or serial number has been removed
